Collection of commercial waste: regulations, equipment and best practices

AGEC Law, bio-waste and source separation: what businesses need to know

The Anti-Waste Law for a Circular Economy (AGEC) has profoundly reshaped businesses' obligations regarding waste sorting. Since January 1, 2023, all organizations—businesses, associations, local authorities, and food retailers—are required to sort their biowaste at the source and direct it to an organic recovery stream. The five mandatory waste streams (paper/cardboard, metal, plastic, glass, and biowaste) must be collected separately, regardless of the quantity produced. This obligation also applies to markets and restaurants, which until now could group their waste into mixed streams. Failure to comply with these provisions exposes the establishment to prefectural inspections and administrative penalties.

How to choose your bins and recycling containers according to the professional context?

The choice of collection equipment depends on the waste stream to be processed, the daily volume, and the layout of the spaces. In restaurants, a compact recycling bin (15 to 35 liters) placed in the kitchen is essential for food waste, while a double or triple bin covers other waste streams. In public spaces or office buildings, 3- or 4-compartment recycling bins allow for the collection of glass, paper, packaging, and residual waste at a single point. In public spaces or on public roads, resistance to vandalism, weatherproofing, and ease of emptying for cleaning staff become the determining factors. Outdoor ashtrays designed to prevent cigarette butts are also mandatory in designated smoking areas of establishments open to the public.

Professional garbage bags: thickness, color and biodegradable conformity

The garbage bag is the most frequently used consumable and often the least optimized item in professionals' hygiene budgets. Its selection should take into account three main criteria: capacity in liters (from 20 L for office bins to 240 L for wheeled containers), thickness in microns (from 20 µm for light waste to 80 µm and more for heavy or sharp waste), and material. For biowaste streams subject to AGEC regulations, bags must be certified compostable according to the EN 13432 standard, and not simply biodegradable: this distinction is verified during audits. Standardized color codes (yellow for recyclables, brown for biowaste, gray or black for residual waste) facilitate the adoption of sorting by teams on a daily basis.
